RENTAL AGREEMENT AND LIABILITY WAIVER

This Agreement is entered into between you, the “Customer,” and Siede Enterprises LLC (“Rueditas Mágicas”). Rueditas Mágicas remains the sole owner of all rental equipment. Rueditas Mágicas does not offer the equipment for sale, and the Customer is not purchasing the equipment. The Customer acknowledges that the equipment is intended for personal use only. By signing and accepting the terms and conditions of this Rental Agreement, the Customer acknowledges that they have read, understood, and agree to the terms set forth below.

RESERVATIONS AND RENTAL PAYMENTS


The Customer’s reservation is attached hereto and incorporated by reference.

Payment is made by credit or debit card at the time the reservation is placed. The Customer authorizes Rueditas Mágicas to make modifications, adjustments, and additions to the payment method for the purpose of issuing credits, refunds, and charging any services or fees associated with the reservation.

Rueditas Mágicas will confirm the reservation by email within 24 hours. The Customer must contact Rueditas Mágicas if a confirmation email is not received within 24 hours of making an online or phone reservation.

Product colors may vary from the images displayed.

DELIVERY, POSSESSION, AND USE


At the time of booking, the Customer must specify the name and location of the resort, hotel, or vacation home in the Orlando theme park area where the rental items will be delivered and collected. The Customer understands that delivery and return locations and procedures may vary depending on the selected location.

The exact time and location for both delivery and return pickup will be communicated to the Customer by email. If the Customer is unsure of the delivery or return pickup location, the Customer agrees to contact Rueditas Mágicas for clarification.

The Customer understands that delivery and pickup services are based on locations within the immediate Orlando theme park area and within a 10-mile radius. FREE delivery and pickup are available only at Disney, Universal, and affiliated hotels.

We do not provide delivery services to the following locations:

* Apopka
* Altamonte Springs
* Oviedo
* Clermont
* Haines City

Deliveries to the following locations are available for an additional fee of $10 USD:

* Davenport
* Champions Gate
* Winter Garden

If your stay is within one of these areas, you must add this additional fee during checkout. Please call before placing an order if your requested delivery location is more than 10 miles from Disney.

The Customer agrees to contact Rueditas Mágicas within six (6) hours of the scheduled delivery/return time by phone or email if the rental items cannot be located or received when the agreed delivery/return location is a non-Disney resort.

The Customer agrees to contact Rueditas Mágicas within one (1) hour of the scheduled delivery/return time by phone or email if the Customer is unable to meet a Rueditas Mágicas representative for the personal delivery/pickup of rental items at a Disney-owned resort.

The Customer agrees that if they arrive late, miss their delivery/return appointment, or are unavailable to meet a representative at the agreed time, they may, at the sole discretion of Rueditas Mágicas, request the next available appointment for their designated resort.

The Customer acknowledges and understands that delivery and return pickup at Disney-owned resorts will be conducted face-to-face with a Rueditas Mágicas representative. The Customer agrees to select a delivery and pickup time during which they will be available to meet personally with a representative.

The Customer also understands that only the time slots listed on the website at www.rueditasmagicas.com are available for the selected delivery and pickup locations, unless specific arrangements are approved by Rueditas Mágicas via email.

Delivery and return schedules are published on our website and are available Monday through Sunday. The Customer agrees to select the appropriate time slot.

EARLY DELIVERY


Customers may choose an early delivery time between 7:00 AM and 7:59 AM on weekends and holidays (Saturday and Sunday) for an additional fee of $15 USD. The Customer must select this option during checkout to receive early delivery service.

If the Customer does not add this fee during checkout, delivery will be completed during the first standard delivery time available.

LATE RETURN FEES

An additional fee will be charged for late returns and must be paid in cash at the time of pickup.

Same Day: Additional $5 USD for returns up to 9:00 PM

Same Day: Additional $10 USD for returns between 9:00 PM and 10:00 PM

Next Day: Additional $15 USD for returns up to 12:00 PM

The Customer acknowledges and understands that all requests to modify an existing reservation must be made at least 24 hours prior to the scheduled delivery time. Requests submitted less than 24 hours before the scheduled delivery time will be accommodated solely at the discretion of Rueditas Mágicas.

The Customer acknowledges and understands that every effort will be made to meet the requested delivery time. However, due to traffic conditions or delivery volume, a delivery window of up to 30 minutes from the requested delivery time is permitted.

The Customer further understands and agrees that during periods of severe weather, deliveries and/or pickups may be temporarily suspended for the safety of delivery personnel until management determines that operations can safely resume. Severe weather may include, but is not limited to, tropical storms, hurricanes, tornado warnings, or winds exceeding 25 mph.

The Customer agrees that if no contact is made within 24 hours of the scheduled delivery date, the Customer is deemed to have taken possession of the rental items and accepts all responsibilities associated with their possession.

If a delivery attempt is made to a vacation home or Disney hotel and the Customer is unavailable, or if the Customer has provided an incorrect delivery location requiring a second delivery trip, a redelivery fee of $10 may be charged at the sole discretion of Rueditas Mágicas.

The Customer agrees that they have made every effort to verify that the requested delivery and return locations are within the designated service area and are serviced by Rueditas Mágicas, as described in the FAQ section of www.rueditasmagicas.com.

The Customer understands and agrees that any reservation may be modified or canceled at the sole discretion of Rueditas Mágicas if the requested location falls outside the designated delivery area.

The Customer further understands that rental items returned outside of our designated service area may incur an additional fee ranging from $10 to $20, depending on the location, at the sole discretion of Rueditas Mágicas.

If the Customer travels outside our delivery/pickup area and cannot return, it is the Customer’s responsibility to ensure that all rented items and related accessories are returned to Rueditas Mágicas on the original return date by taxi, rideshare service, courier, or shipping carrier (including FedEx, UPS, USPS, etc.). All costs associated with such returns shall be the sole responsibility of the Customer.

The Customer acknowledges that any reservation may be modified or canceled at the sole discretion of Rueditas Mágicas if the company determines that the health or safety conditions of the requested hotel, resort, or vacation home (delivery or pickup location) are detrimental to the nature of its business operations.

The Customer agrees to maintain possession of the rental item throughout the rental period. Rental items must be kept secure when not in use, including inside hotel rooms or vehicles.

Rental items must not be left with bell services or luggage storage facilities for daily storage purposes. Items left with bell services or luggage storage may be considered abandoned or returned early and may be subject to retrieval by Rueditas Mágicas.

Items left with bell services or luggage storage facilities are not covered under the optional insurance protection plan.

The Customer agrees to immediately notify Rueditas Mágicas of any defect or malfunction encountered during use. Upon notification, Rueditas Mágicas will make every reasonable effort to resolve the issue promptly.

The Customer agrees to use the rental item only for its intended purpose and in the manner for which it was designed. Under no circumstances may the published weight limits of the rental items be exceeded.

The Customer understands that violations of this Agreement may result in termination of the rental. Rueditas Mágicas reserves the right to terminate any rental based on evidence of misuse or violation of any provision of this Agreement.

The Customer agrees to return all rented equipment and accessories immediately upon request by Rueditas Mágicas. At its sole discretion, Rueditas Mágicas may refund any portion of the rental it deems appropriate.

The Customer acknowledges that, upon request, any stroller replacement due to, including but not limited to, rain exposure, child vomit, leaking diapers, or other bodily fluids may be subject to a $10 replacement fee at the sole discretion of Rueditas Mágicas.

RETURN OF EQUIPMENT


The Customer is responsible for ensuring that all rental items are available for pickup at the designated resort, hotel, or vacation home on the date and time specified in the reservation.

All rental items must be returned to the bell services desk or front desk of the resort or hotel listed in the confirmation email. Under no circumstances should rental items be left inside a guest room after checkout.

Disney hotels do not store rental items at the front desk or luggage storage area. Rental items left in guest rooms will incur a $25 retrieval fee.

The Customer is fully responsible for ensuring that rental items are available at the bell services desk or front desk for pickup.

For vacation home returns, we prefer that someone be available at the property to meet our representative. Please note that morning pickups may occur between 7:00 AM and 10:00 AM depending on location, additional-area pickups, and driver availability.

The Customer agrees to contact Rueditas Mágicas if rental items are returned before the agreed return date. Failure to notify Rueditas Mágicas will void any stroller insurance coverage purchased.

Disney-Owned Resorts

The Customer is responsible for being available at the agreed time and location for return pickup. The Customer acknowledges and understands that return pickups at Disney-owned resorts must be completed face-to-face with a Rueditas Mágicas representative.

If the Customer is unable to meet the representative at the agreed time and location, the return may be rescheduled to the next available time slot at the sole discretion of Rueditas Mágicas.

If the Customer wishes to extend the rental period, they must contact Rueditas Mágicas before the scheduled return time. Rueditas Mágicas may approve or deny any extension at its sole discretion.

Rueditas Mágicas reserves the right to charge the Customer’s payment method for each additional day or partial day that rental items remain in the Customer’s possession, and the Customer authorizes such charges.

The Customer agrees to contact Rueditas Mágicas if rental items cannot be returned at the agreed time. Any grace period granted shall be entirely at the discretion of Rueditas Mágicas.

A $10 service fee may be charged for additional return trips required to collect rental items that were not returned at the agreed time specified in the reservation or otherwise prearranged with Rueditas Mágicas.

The Customer may request a product exchange due to size requirements or transportation concerns. Such requests are subject solely to product availability and the discretion of Rueditas Mágicas and may be subject to additional upgrade and delivery fees.

DAMAGE OR LOSS OF EQUIPMENT

The Customer accepts the rental items listed in the reservation in their current condition (“as is”) and assumes full responsibility for the care of the equipment while it is in the Customer’s possession.

The Customer is responsible for paying the full replacement value of any rental item rented under this Agreement that is not returned to Rueditas Mágicas within 48 hours after the end of the rental period. The Customer also authorizes Rueditas Mágicas to charge the Customer’s credit card for the replacement cost of any rental item not returned. If a rental item is recovered after the replacement charge has been processed, a full refund of the replacement charge will be issued to the Customer.

The Customer is responsible for paying the replacement cost of any lost part or accessory, whether purchased separately or provided free of charge. These items include, but are not limited to, shoulder pads, harnesses, parent consoles, rain covers, cooler bags, glider boards, and car seat adapters. Such items may be provided for an additional fee or free of charge and are not guaranteed to be available during the rental period.

The Customer is responsible for any loss, theft, damage, or destruction of rental items and agrees to pay the full replacement value of the rental equipment. The Customer further authorizes Rueditas Mágicas to charge the Customer’s credit card for such replacement costs.

The Customer agrees to return all rental items in the same condition in which they were delivered and to immediately report any loss, theft, damage, or destruction of rental items to Rueditas Mágicas.

The Customer acknowledges that they were offered the opportunity to purchase insurance coverage for theft, damage, or destruction of rental items and have elected to purchase or decline such insurance.

INSURANCE WAIVER TERMS AND CONDITIONS

Insurance coverage for theft, destruction, or accidental damage is available for purchase before the completion of this Agreement and at any time prior to taking possession of the rental items. Insurance coverage is not available once possession of the rental items has been taken.

It is solely the Customer’s responsibility to determine whether to purchase an insurance waiver. At no time shall Rueditas Mágicas guarantee or imply that the Customer’s responsibility for rented items is waived without the purchase of insurance coverage.

The insurance waiver shall be void in the event of fraud or misrepresentation.

The insurance waiver does not cover rental items that are not returned to the proper location or items left in guest rooms.

The insurance waiver applies only to items rented from Rueditas Mágicas and does not cover any personal belongings of the Customer or guests.

Insurance coverage ends at the designated return time listed on the reservation. Items not returned before the designated return time will no longer be covered under the insurance waiver.

Insurance coverage applies only to the Customer who rented the item(s) from Rueditas Mágicas and purchased the insurance waiver. The insurance waiver is non-transferable and may not be assigned to any other individual. The insurance waiver remains valid only while the rental items remain under the Customer’s possession and control. The Customer forfeits any insurance claim benefits if possession or control of the rented items is transferred to any person not listed on the original rental agreement.

An insurance waiver purchased by the Customer shall be considered null and void in the following circumstances:

* The Customer abandons the rental items during the rental period.

* The Customer disassembles or removes parts not intended to be removed during normal operation.

* The Customer uses the rental item for purposes other than its intended use.

* The Customer fails to communicate changes to the agreed delivery or pickup locations.

* The Customer fails to notify Rueditas Mágicas immediately after discovering a stolen item (within two hours of discovery). * The Customer fails to file a lost/stolen item report with the theme park or resort where the loss occurred within two hours of discovering the loss.

INSURANCE DOES NOT COVER THE FOLLOWING:

* Rental items abandoned, left behind, or forgotten at a theme park, shopping center, or other facility.

* Rental items abandoned, left behind, or forgotten on a bus, car, taxi, rideshare, or any other form of transportation.

* Rental items left unsecured at a hotel, resort, or vacation home.

* Damage caused to another person’s property or equipment.

* Damage to or discoloration of stroller fabric caused by sunscreen, tanning lotions, sprays, or similar products.

* Marker or pen stains inside the stroller.

* Loss of shoulder pads, shoulder straps, lap belts, or any harness equipment removed by the Customer.

Please Note: Insurance does not cover replacement of rental items due to vomit, bathroom accidents, or similar incidents. Insurance also does not cover stroller replacements resulting from rain exposure or other events beyond the control of Rueditas Mágicas.

Rueditas Mágicas offers rain covers for an additional fee to help protect strollers from weather conditions. A $10 replacement fee may be charged for replacing a wet stroller and is subject to model availability.

If a rented item is believed to have been stolen, the Customer must obtain a report from theme park security and provide a copy of that report to Rueditas Mágicas. If the incident occurs outside a theme park, the Customer must file a police report with the local law enforcement agency and provide a copy to Rueditas Mágicas.

Any suspected theft must be reported to theme park security, local law enforcement, and Rueditas Mágicas within two hours of the incident. Notification must be submitted by email. Failure to report the incident within the required timeframe will void any insurance coverage purchased for the rental item.

Insurance coverage represents a transfer of replacement-cost liability from the Customer to Rueditas Mágicas for the specific item covered by the purchased insurance. Insurance coverage does not guarantee a replacement item if the original item is lost or stolen. A new rental reservation must be made to obtain a replacement item.

CANCELLATION POLICY

A full refund will be issued for cancellations made 48 hours or more before the rental start date.

Cancellations made within 48 hours of the rental start date will be subject to a minimum rental fee of:

* $40 for a single stroller

* $50 for a double stroller

Refunds for reservations made more than 120 days before the cancellation date will be issued via PayPal or to the original payment method used for the reservation.

LIABILITY WAIVER

By accepting and using the rental equipment, the Customer and any user acknowledge that the equipment is used entirely at their own risk.

Rueditas Mágicas makes no warranties regarding the rental equipment and specifically disclaims all warranties, whether express or implied.

Rueditas Mágicas, its employees, owners, and affiliates shall not be liable for any accident, injury, loss, or damage caused directly or indirectly by the use or misuse of the rental equipment.

The Customer and any user agree to release, indemnify, and hold harmless Rueditas Mágicas, its employees, owners, and affiliates from any liability, injury, death, property loss, or damages that may result directly or indirectly from the use of the rental equipment.

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
